4. Booking and Contract Formation

A booking is considered confirmed only when:

the client has provided the required personal information,
the required deposit or full payment has been received, and
Machupicchu Destinations has issued a written confirmation by email or other official communication channel.

All reservations are subject to availability, especially for high-demand services such as Machu Picchu entrance tickets, train tickets, and trekking permits.

Machupicchu Destinations reserves the right to decline a booking when availability cannot be secured, when required information is incomplete, or when the client does not comply with the payment deadlines established in the reservation process.

5. Client Information and Responsibility

The client is responsible for providing accurate and complete information at the time of booking, including:

full name exactly as shown on passport or ID,
passport or identity document number,
nationality,
date of birth,
contact information,
medical conditions relevant to the trip,
dietary restrictions where applicable.

If the client provides incorrect information and this affects the booking, admission to attractions, train boarding, permits, or other services, Machupicchu Destinations shall not be responsible for the resulting losses, denied entries, or additional costs.

6. Prices and Inclusions

Unless specifically indicated, tour prices include only the services expressly listed in the tour description or booking confirmation. Any service not expressly mentioned as included shall be deemed excluded.

Prices may vary due to:

Once a booking is confirmed and paid according to the agreed terms, the confirmed price will generally be honored, except where changes are required by government authorities, attraction administrators, transport operators, or force majeure events.

7. Deposits and Payment Terms

To secure a reservation, clients may be required to pay either:

full payment,

depending on the type of service booked.

High-demand services such as Machu Picchu tickets, Inca Trail permits, train tickets, and custom packages: higher deposit or full prepayment may be required

The remaining balance, if applicable, must be paid within the deadline indicated in the booking confirmation.

If payment is not completed on time, Machupicchu Destinations reserves the right to cancel the booking or release reserved spaces without liability.

Any bank charges, card processing fees, transfer fees, or currency conversion fees are the responsibility of the client unless otherwise agreed in writing.

8. Cancellations by the Client

All cancellation requests must be submitted in writing by email or through the official communication channel used for the reservation.

Cancellation charges may apply depending on the type of service, how far in advance the cancellation is requested, and whether the service involves non-refundable third-party components.

Suggested cancellation policy structure

For standard tours and packages

More than 30 days before departure: partial refund, less administrative and non-recoverable costs
15 to 29 days before departure: partial refund subject to supplier penalties
8 to 14 days before departure: limited refund or credit only
0 to 7 days before departure: non-refundable

For non-refundable or restricted services
The following are commonly non-refundable or partially non-refundable once purchased or issued:

Machu Picchu entrance tickets
Train tickets
Inca Trail permits
Other government-controlled permits
Special event or holiday services
Customized services purchased specifically for the client

When a service provider applies its own cancellation rules, those rules will prevail for that service.

9. Changes Requested by the Client

Any request to change dates, passenger names, passport details, routes, hotels, trains, entrances, or other booked services is subject to:

availability,
supplier rules,
government regulations,
additional costs,
applicable administrative fees.

Certain services, especially permits and entrance tickets, may not allow date changes, name changes, or refunds once issued.

Machupicchu Destinations will make reasonable efforts to assist with modification requests, but cannot guarantee that changes will be possible.

10. Cancellations or Modifications by Machupicchu Destinations

Machupicchu Destinations reserves the right to modify itineraries, schedules, transportation arrangements, accommodations, routes, or service sequence when necessary for operational, safety, weather, availability, or regulatory reasons.

If a major part of the booked service cannot be provided due to circumstances within our reasonable control, we may offer one of the following:

an alternative of similar nature and value,
a travel credit,
a partial refund for the affected unused portion,
another reasonable solution depending on the case.

If the cancellation or modification is caused by third-party suppliers, government restrictions, natural events, social disruptions, access closures, or force majeure, refunds will be subject to actual recoveries obtained from suppliers and applicable non-recoverable costs.

11. Force Majeure

Machupicchu Destinations shall not be liable for failure, delay, interruption, modification, or cancellation of services due to events beyond its reasonable control, including but not limited to:

weather conditions,
natural disasters,
landslides,
floods,
fires,
epidemics or health emergencies,
strikes,
protests,
road blockages,
airport disruptions,
train service interruptions,
political unrest,
acts of government,
closures imposed by authorities,
other unforeseeable or unavoidable events.

In such cases, we will try to offer reasonable alternatives where possible, but additional costs arising from these events may be the responsibility of the client.

12. Travel Documents

Each traveler is solely responsible for carrying valid travel documents, including:

passport,
identity document,
visas if required,
travel insurance documentation,
vaccination or health certificates if required,
any special permits required by law.

Machupicchu Destinations is not responsible if a traveler is denied boarding, denied entry, or denied participation due to missing, invalid, damaged, or inconsistent documentation.

13. Health, Fitness, and Special Conditions

Many tours in Peru, especially those in Cusco, Machu Picchu, Sacred Valley, high-altitude destinations, and trekking routes, involve physical effort, altitude exposure, variable weather, uneven terrain, and limited medical access.

By booking a tour, the client confirms that they are physically and mentally fit to participate in the selected service, or that they have sought appropriate medical advice before traveling.

Clients must inform Machupicchu Destinations in advance of any condition that may affect participation, including but not limited to:

heart conditions,
respiratory problems,
mobility limitations,
recent surgeries,
pregnancy,
severe allergies,
other relevant health issues.

Machupicchu Destinations reserves the right to refuse participation, or require route or service adjustments, where participation may create a risk to the traveler, the group, or staff.

14. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance covering, where applicable:

trip cancellation,
trip interruption,
medical expenses,
accidents,
evacuation,
baggage loss,
delays,
personal liability.

Travel insurance is especially recommended for trekking, adventure activities, and multi-day programs.

15. Assumption of Risk

The client acknowledges that travel and adventure tourism activities may involve inherent risks, including but not limited to:

altitude sickness,
slips and falls,
weather-related hazards,
transport delays,
trail conditions,
limited medical facilities in remote areas.

By participating in these services, the client accepts such inherent risks to the extent permitted by applicable law.

16. Third-Party Suppliers

Machupicchu Destinations may act as an intermediary for certain services provided by third parties, including hotels, airlines, train operators, bus companies, restaurants, local operators, and attraction administrators.

In such cases, those services are also subject to the terms, conditions, operational rules, and limitations imposed by the respective supplier.

Machupicchu Destinations shall not be liable for acts, omissions, delays, closures, rescheduling, or service deficiencies directly attributable to third-party providers, except where liability cannot be excluded under applicable law.

17. Baggage and Personal Belongings

Clients are responsible for their own luggage and personal belongings at all times unless a specific custody service has been expressly included.

Machupicchu Destinations is not responsible for loss, theft, deterioration, or damage to luggage, documents, valuables, electronic items, or personal effects during the trip, whether in transport, accommodation, stations, attractions, or public areas.

We recommend not carrying unnecessary valuables.

18. Conduct and Right to Refuse Service

Clients are expected to behave respectfully toward guides, staff, drivers, local communities, fellow travelers, heritage sites, and natural environments.

Machupicchu Destinations reserves the right to refuse service or remove a participant from a tour, without refund, if the participant:

behaves aggressively or abusively,
places others at risk,
violates local law,
causes serious disruption,
is under the effects of alcohol or drugs in a manner that affects safety,
damages property or heritage,
fails to follow essential guide or safety instructions.
19. Child Protection and Ethical Tourism

Machupicchu Destinations rejects all forms of exploitation, abuse, and unsafe conduct affecting children and adolescents and supports responsible tourism practices aligned with Peruvian tourism policy and protection standards. Peru’s tourism framework includes measures and instruments related to the prevention of sexual exploitation of children and adolescents in tourism activities.

20. Complaints and Customer Service

If a client experiences a problem during the trip, they must notify Machupicchu Destinations as soon as possible so that a reasonable effort can be made to address the issue during the service.

If the issue is not resolved on-site, the client may submit a formal complaint through our official customer service channels.

Under Peruvian consumer protection rules, providers must make the Libro de Reclamaciones available and attend claims within the applicable legal framework.

21. Privacy and Data Protection

Machupicchu Destinations may collect and process personal information necessary to provide quotations, reservations, operational coordination, customer support, legal compliance, and service improvements.
